Claim Statutory Maternity Pay as an Umbrella Company Employee

One of the main benefits of being an employee of an umbrella company, as opposed to working under your own limited company, is that you have full access to state benefits including Maternity Allowance.

This is great news for mothers on maternity leave as they will receive Maternity Allowance income while not working.

Women can take up to 52 weeks maternity leave with maternity payments for a maximum of 39 weeks.

How is Statutory Maternity Pay (SMP) calculated?

SMP is calculated using the following formula:

 

First 6 weeks of maternity leave

Following 33 weeks

SMP Rate

90% of Average Weekly Earnings (AWE)

£136.78 or 90% of AWE

Do I Qualify for SMP?

There are certain conditions that must be met in order to qualify for Maternity Pay.

You must have been employed continuously by your umbrella company for at least 26 weeks by the 15th week before the due date.

You must provide your umbrella company with the MAT B1 certificate no less than 28 days before your maternity payments start.

Your minimum Average Weekly Earnings (AWE) must be at least £109 a week.

If you do not qualify for SMP, you may still be able to claim Maternity Allowance (MA). Complete the SMP1 form and book an appointment at your local Job Centre Plus to see whether you are entitled to claim Maternity Allowance.
